RULES AND REGULATIONS
Star Movies India (“Channel”) announces the “Star Movies Chills & Thrills Contest” (“Contest”) hosted by Star India Private Limited (“Star India”) on its Star Movies India Facebook Page. The Contest is based on the upcoming 11 PM festival on Star Movies – Chills & Thrills – in July 2012 in India (“Festival”). The Contest shall be pertaining to the Festival where a question shall be posted each day from the movie that shall be aired during the Festival.
The following are the rules for the Contest” (“Contest”) which will be hosted by Star India and/or the “Channel” and reside on Star Movies India Facebook as stated hereunder.
Principle Rules
1. The Contest shall be based on the upcoming 11 PM festival on Star Movies – Chills & Thrills – in July 2012 in India (“Festival”).
2. The Channel shall announce the contest on 4th July, 2012 at approximately 11.00 hours Indian Standard Time (IST) on Star Movies India Facebook page at the URL http://www.facebook.com/StarMoviesIndia (“Star Movies India Facebook page”).
3. The Contest will be hosted on Star Movies India Facebook page and will be held over a span of 4 weeks and is scheduled as stated below (“Period”):
I Contest for Weekly Winners
• 1st week: the Contest for the 1st week will commence on July 4th, 2012 at 11.00 hours IST and conclude on July 10th, 2012 at 18:00 hours IST
• 2nd week: the Contest for the 2nd week will commence on July 11th 2012 at 11.00 hours IST and conclude on July 17th 2012 at 18:00 hours IST
• 3rd week: the Contest for the 3rd week will commence on July 18th 2012 at 11.00 hours IST and conclude on July 24th 2012 at 18:00 hours IST
• 4th week: the Contest for the 4th week will commence on July 25th 2012 at 11.00 hours IST and conclude on July 31st 2012 at 18:00 hours IST
II Contest for Grand Prize Winner
• The Contest shall commence on July 4th, 2012 at 11.00 hours IST and conclude on July 31st, 2012 at 18:00 hours IST.
4. For participating in the Contest, all participant(s) must have a Facebook account at the URL www.facebook.com, (“Participant(s)”), login into their Facebook account, visit the Star Movies India Facebook page at www.facebook.com/StarMoviesIndia and answer one question on the Chills & Thrills tab which will be based on the movie being aired on the Channel, (“Entries”) and give personal details which shall include but not be limited to the Participant(s) complete name, contact address, contact number (‘Participant Information’). The Participant Information’ provided by the Participant(s) shall not be used for any other purpose other than for contacting the Participant, in the event they are declared as winners of the Contest.
5. Entries will be considered null and void if the mandatory Participant Information is not filled in.
6. Entries sent after the Period will not be considered for the Contest and shall be deemed null and void.
7. In case of network failure and/or for any reasons whatsoever, STAR India reserves the right to change the entry system/mechanism and/or cease accepting Entries of the participant(s) during the Period or take such necessary steps as it may deem fit in its sole and absolute discretion.
8. The Participant(s) on registering themselves, may log on to the Star India Facebook Page and answer question based on the movie to be aired on the Channel during the Festival. Every day a new question shall be asked on the Star India Facebook page based on the movie to be aired on the Channel during the Festival.
9. At the end of each week stated in Clause 3, Star India and/or the Channel will by a process of random selection select 10 (ten) Participant(s) in total, from amongst the Participant(s) who have given maximum correct answers each week (“Weekly Winner(s)”). In a situation where more than 10 Participant(s) have given the same number of correct answers, Star India and / or Channel shall, by a process of random selection, select 10 Weekly Winners each week. The Weekly Winner(s) shall stand a chance to win merchandise from Star Movies, the value of which shall not exceed Rs. 2,000/- (Rupees Two Thousand Only) (“Weekly Prize”).
10. After the end of the Period, Star India and / or Channel will select one (1) winner, who has given maximum number of correct answers throughout the month (“Grand Prize Winner”). In case, more than one Participant has given same number of correct answers, Star India and / or Channel will randomly select one winner amongst them. The Grand Prize Winner shall be eligible to win a Samsung Galaxy Note the value of which shall not exceed Rs. 35,000 (rupees thirty five thousand only)(“Grand Prize”).
11. STAR India and/or the Channel reserves the right to select the Weekly Winner(s) and the Grand Prize Winner of the Contest and such decision shall be final and binding on the Participant(s).
12. Star India and/or the Channel will announce the Weekly Winner(s) on below dates for each week on or around 18.00 hours IST on Star Movies India Facebook page:
• 1st Week Winners: 13th July, 2012
• 2nd Week Winners: 20th July, 2012
• 3rd Week Winners: 27th July, w012
• 4th Week Winners: 3rd August, 2012
13. The Grand Prize Winner will be announced on 6th August, 2012 on or before 18.00 hours, IST on Star Movies India Facebook page.
14. STAR India and/or the Channel shall courier the prizes to Weekly Winners and the Grand Prize Winner on the addresses (in India only) as provided by them at the time of entering the Contest.
15. STAR India and/or the Channel shall make a total of two (2) attempts to contact the Grand Prize Winner on the number as provided by him / her at the time of entering the Contest. If the Grand Prize Winner does not answer the call in both the attempts, the Grand Prize will automatically be transferred to the next Participant(s) at the sole discretion of Star India and/ or the Channel.
16. After dispatch of the Weekly Prize and/or the Grand Prize at the given address by courier, in case during transit, if any loss/damage etc. is caused/incurred, Star India and/ or the Channel will not be liable for any such loss/damage etc. Further, Star India and/or the Channel shall not be responsible or liable for any technical disruption and/or failure and/ or any other difficulties of such nature, due to which the Weekly Winner(s) and/or the Grand Prize Winner is un-reachable or any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which Star India and/or Channel is unable to intimate the Weekly Winner(s) and/or the Grand Prize Winner.
17. Neither STAR India and/or Channel nor its employees have given a guarantee regarding the quality of the Weekly Prize and/or the Grand Prize and the Weekly Winner(s) and/or the Grand Prize Winner agree not to hold STAR India and/or the Channel and its employees, responsible with regards thereof. It is clarified that STAR India and/ or Channel shall not be responsible for the brand, quality, value etc. in connection to the Prize and the supplier/ manufacture shall be solely responsible for the same. Also Star India shall not be under any obligation to provide any receipts/source of Weekly/Grand Prize to any person/winners of such Prize
18. STAR India/Channel will not be responsible nor shall be held liable for defect in the Weekly Prize and/or the Grand Prize, if any.
19. STAR India and/or the Channel reserve the right to disqualify any Participant(s) from participating in the Contest without assigning any reason. The decision of STAR India and/or the Channel in this regard shall be final and binding upon the participant(s).
20. Star India and/or Channel shall not be responsible or liable for any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which the participant(s) is unable to participate in the Contest.
21. By participating in the Contest, it is construed that the Participant(s) has read and understood these Principle Rules including the General Rules stated below and has agreed to abide by the same.
General Rules:
1. STAR India and/or the Channel reserves all rights to make amendments to the existing rules and regulations or withdraw the Contest without giving prior notice. It shall be the sole responsibility of the Participant(s) to check the rules and regulations of the Contest on [URL :___________________]
2. Non-conformance by the Participant(s) to any and all the rules will make such Participant’s entry(ies) null and void.
3. The Participant(s) shall hold harmless the sponsor, the Channel, STAR India, its affiliates, its group companies, their employees, officers, directors or any other person from and against any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the Participant(s) ,in any manner whatsoever in connection with the Contest and/or the Prize and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs.
4. Employees of and/or consultants of and/or persons hired on contract by STAR India, the Channel, the sponsor and the members of their immediate family are ineligible for participating in the Contest.
5. By participating it is deemed that the Participant(s) have read, understood, accepted and agree to abide with all the rules and regulations of the Contest.
6. The Weekly Winner(s) and/or the Grand Prize Winner agrees that he/she shall not hold STAR India and/or Channel and/or their employees, responsible for delays or any problem in connection to the Weekly Prize and/or the Grand Prize.
7. STAR India shall not be responsible to pay for any taxes, duties, charges, license fees, insurance and/or levies applicable under the laws of India, in relation to the Weekly Prize and/or the Grand Prize and the same, if applicable, shall be solely borne by the Weekly Winner(s) and/or the Grand Prize Winner.
8. Neither STAR India nor the Channel nor their employees have given any guarantee and/or warranty regarding quality, brand, value, durability etc. of the Weekly Prize and/or the Grand Prize. Neither STAR India nor the Channel nor their employees shall be responsible and/or liable for any reason whatsoever in connection thereto.
9. The Weekly Winner(s) and/or the Grand Prize Winner agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or STAR India, the Weekly Prize and/or the Grand Prize and/or anything in connection to the Weekly Prize and/or the Grand Prize and/or the enjoyment of the Weekly Prize and/or the Grand Prize becomes ineffective or invalid, the Channel and/or STAR India cannot be held responsible and/or liable for the same.
10. The Channel and/or STAR India is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the Participant(s) and/or the Weekly Winner(s) and/or the Grand Prize Winner in any manner whatsoever or for any reason whatsoever in connection to the Contest and/or Weekly Prize and/or the Grand Prize.
11. The Weekly Winner(s) and/or the Grand Prize Winner cannot exchange the Weekly Prize and/or the Grand Prize respectively for another item or cash equivalent. If the Weekly Winner(s) and/or the Grand Prize Winner refuses to accept the Prize awarded, the Channel and/or STAR India shall be released from all obligations towards the Weekly Winner(s) and/or the Grand Prize Winner in connection to the Weekly Prize and/or the Grand Prize won by the Weekly Winner(s) and/or the Grand Prize Winner respectively. Further, after forfeiting the Prize, STAR India and/or the Channel shall be entitled to randomly select and declare another Weekly Winner(s) and/or the Grand Prize Winner, as it deems fit, and award the Weekly Prize and/or the Grand Prize, to that Weekly Winner(s) and/or the Grand Prize Winner.
12. STAR India and/or the Channel reserve the right to forfeit the Weekly Prize and/or the Grand Prize in the event it is found by STAR India and/or the Channel that any information provided by the Participant(s) and/or the Weekly Winner(s) and/or the Grand Prize Winner is wrong, fraudulent or any misrepresentation is made by the Participant(s) and/or the Weekly Prize and/or the Grand Prize. STAR India or the Channel shall have the right to declare another participant(s) as the Weekly Winner/or the Grand Prize Winner as the case may be ,of the Contest and transfer the Weekly Prize and/or the Grand Prize to that person.
13. The Weekly Winner(s) and/or the Grand Prize Winner, shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or STAR India in its sole and absolute discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India and/or the Channel herein.
14. The Weekly Winner(s) and/or the Grand Prize Winner of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or STAR India and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Weekly Winner(s) and/or the Grand Prize Winner. Further, the Weekly Winner(s) and/or the Grand Prize Winner shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Weekly Winner(s) and/or the Grand Prize Winner agrees that the footage of any nature with regard to the Weekly Winner(s) and/or the Grand Prize Winner shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.
15. By participating in the Contest, it shall be construed that the Participant(s) and/or the Weekly Winner(s) and/or the Grand Prize Winner has waived his/her right to raise any dispute with regard to the Contest and/or the Weekly Prize and/or the Grand Prize, in any manner whatsoever.
16. All and any incidental costs direct and/or indirect, in relation to the Weekly Prize and/or the Grand Prize , shall be borne by the Weekly Winner(s) and/or the Grand Prize Winner and in no manner whatsoever shall the Channel and/or STAR India, be responsible or liable for the same in any manner whatsoever.
17. These rules and regulations shall be construed and governed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest and/or the Weekly Prize and/or the Grand Prize shall be referred to a sole arbitrator appointed by STAR India and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the participant(s)/Winner (s) who has raised the dispute.
18. Subject to the provision of Clause 19 above, the Courts having jurisdiction under the provisions of the Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to determine under the Act, including, without limitation, provision of interim relief’s under the provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the courts at Mumbai, India.
