Step 2: Check out the nearest CCD outlet from the list given.

Step 3: Visit one of the CCD outlets to experience the TAB2 and participate in the contest to win TAB2. Only those who take the demo of the TAB2 at the selected CCD outlets will be eligible for winning TAB2.

GENERAL TERMS & CONDITIONS FOR THE CONTEST

1. Introduction

  

1.1 These Terms and Conditions shall be binding on the Participant when entering in to the Contest.

1.2 These Terms and Conditions apply to all Participants. The Terms and Conditions may be amended by Samsung from time to time without any prior notice.

1.3 No purchase or payment is required to enter in to this Contest.

1.4 Entry and participation in the Contest shall be deemed an unconditional acceptance by the Participant of these Terms and Conditions. All entry instructions and any other specific details relating to the Contest or the prizes form part of these Terms and Conditions.

2. Eligibility

 2.1 Participant must be citizen of India residing in India only and having a valid Facebook Profile and a valid cellular GSM, CDMA phone or landline connection that is accessible at all times. Employees of Samsung, their immediate families, agencies, sponsors and commercial partners or any other persons directly or indirectly connected with the Contest are not eligible to enter into this contest.

2.2 A Participant needs to be a fan of the Samsung Mobile India Facebook Page throughout the period till the time winner is announced, to win the Prize.

2.3 Participant must provide personal details as reasonably requested to do so by Samsung. Refusal to comply will result in disqualification from the Contest.

2.4 All decisions of Samsung relating to the Contest shall be final and binding. No correspondence regarding any dispute will be entertained.

3. Prizes

3.1 Each winner shall be given one TAB2 310 each free of cost.

3.2 Samsung reserves the right to verify the receipt of the Prize by the Winner either on its own or through its authorized agency / person and the Winner shall provide all necessary assistance in such verification. Samsung reserves the right to verify the authenticity of the winner’s identity, resident status in India and age. In exercising this right, Samsung may ask the winner to provide any documentary or other form of evidence, and if evidence does not establish the same then Samsung, in its sole discretion, will have the right to disqualify the winner.

3.3 Samsung will not be liable for delay in delivery of Prizes due to non-availability of stocks or for any other reason beyond its control.

3.4 The winners will be declared as a wall-post on the ‘Samsung Mobile India’ Facebook fanpage. The winners will also be sent a Facebook Inbox message from Samsung Mobile India about the same.

3.5 The winners must contact Samsung Mobile India within 15 days from the date of announcement of the result. Winners who do not claim their prize within 15 days of being notified will automatically forfeit their right to the prize.

3.6 Any request for exchange of Prize for cash or any other form of gratification or reward will not be entertained. The Prizes are non-transferable.

4. The Contest

  

4.1 Fraudulent or incorrect entries will not be accepted (at the absolute discretion of Samsung).

4.2 Winners will be chosen randomly and shall be contacted by Samsung Mobile India via Facebook Inbox message to claim their prizes.

4.3 The decision of Samsungs judges in announcing the winner is final and conclusive in all circumstances and no correspondence will be entertained in this respect.

4.4 Samsung may terminate this Contest at any time at its absolute discretion. In the event of such termination, Samsung may, at its absolute discretion, elect not to award any prize in respect of the terminated Contest.

4.5 The Contest is in no way sponsored, endorsed or administered by, or associated with Facebook or any other entity.

5. Confidentiality

 Samsung undertakes not to disclose, reveal, communicate or otherwise make public to anyone at any time the personal information of the Participant except for the purpose of using the same to communicate to the Participant the winner of the Contest.

6. Limitation Of Liability

  

6.1 The Participant acknowledges that his/her participation in the Contest shall be at his/her own risks.

6.2 Samsung, its agents, sponsors, representatives, affiliates and their respective directors, officers and employees, agents and assigns shall not be liable to any Participant in respect of any failure to win a Prize in the Contest, defective Prizes or misuse of Prizes or any other loss, damages, costs, expenses, claims, liabilities, injury, death, accidents suffered by the Participant during the Contest or arising out of or in connection with the Contest, the participation by the Participant in the Contest and/or the Prizes awarded.

6.3 Samsung will not be responsible or liable for:

6.3.1 any problem, loss or damage of whatsoever nature suffered by the Participant or any party due to any delay and/or failure in receiving and sending a Contest Entry as a result of any network, communication, ISP or system error, interruption and/or failure experienced by Samsung or the Contestant’s telecommunication service provider and/or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption and/or failure, Samsung shall not be responsible or liable for any failure encountered by any Participant to participate in the Contest or any failure encountered by Samsung in fulfilling its obligations hereunder.

6.3.2 Any error (including error in notification of Contest winners), omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside Samsung’s control.

7. General Conditions

  

7.1   Samsung, its agents, sponsors and representatives shall not be liable to perform any of their obligations in respect of the Contest and this Terms and Conditions, rules and regulations in respect of the Contest where they are unable to do so as a result of circumstances beyond its control and shall not be liable to compensate the Participants in any manner whatsoever in such circumstances. 

7.2   The Participants shall not be entitled to assign any of the rights or sub-contract any of the obligations herein. 

7.3   All details collected by Samsung and/or the Event Management Company from the Participant(s) during this Contest shall become the sole property of Samsung. Samsung and its Event Management Company reserve the right to use the Winner’s details and photograph in any marketing or promotional material and the same shall be the sole property of Samsung. By participating in the Contest, the Participant(s) hereby consents to such use. 

7.4   All logos, trade mark and copyrights belong to Samsung which is the licensed user of the logo, trade mark and copyrights of Samsung in India.  

7.5   Failure by Samsung to enforce any of its right at any stage does not constitute a waiver of those rights. 

8. Warranties

  

8.1 The Participant represents and warrants with Samsung that -

8.1.1 The Participant has met all the eligibility criteria and has the right, authority and power to enter into the Contest in accordance with Terms and Conditions and shall provide such proof as Samsung may require;

8.1.2 The Participant confirms that the Participant has read and understood Terms and Conditions of the Contest and the Participant agrees to abide by the said Terms and Conditions accordingly and agrees to cooperate and to follow all directions given to the Participant.

8.1.3 The Participant agrees that the Participant shall not by act or omission, directly or indirectly bring Samsung into disrepute.

8.1.4 The Participant agrees that the Contestant’s participation in the Contest and/or Programme does not entitle the Participant to wages, salary or any other compensation.

9. Indemnity

  

9.1 The Participants forever waive, release and discharge Samsung, its agencies, sponsors and representatives from and against, any and all liabilities, costs, loss, damages or expenses which the Participant or any party claiming through the Participant hereafter may have arising out of acceptance of any Prize(s) or participation in the Contest including (but not limited to) personal injury and damage to property and whether or not direct, consequential or foreseeable.

9.2   The Participant shall indemnify Samsung, its affiliates, agent and sponsors from and against all liability, cost, loss or expenses suffered thereby as a result of the Contestant’s breach of the Contestant’s warranties and undertakings and any breach of the Terms and Conditions and/or the rules and regulations of the Contest.

10. Dispute Resolution and Governing Law:

  

10.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of India. 

10.2  Any dispute or difference of any  nature whatsoever arising out of or in relation to this contest in any manner incidental thereto or any claim, cross-claim, counter-claim or set off regarding any right, liability, act or omission of any of the Parties hereto shall be referred to the sole arbitration of the Arbitrator to be nominated by Samsung.

10.3 The award of the Arbitrator shall be final, conclusive and binding on both the Parties hereto.

10.4 Such arbitration shall be held at New Delhi and the Courts at Delhi alone shall have the jurisdiction to deal with the arbitration proceedings and the award in accordance with law.

10.5 The Arbitration shall be conducted in English language only.

10.6 The award of the Arbitrator shall be final and binding on the Parties.
