Terms and Conditions

The Contest on Facebook shall commence on 18th September 2012 at 00:00 hrs and will conclude on 9th October 2012 at 23.59 hrs (his/hereinafter referred as "Contest Period").
The Contest is organized by Kotak Mahindra Bank India (his/hereinafter referred to as "Kotak").
Contestant eligible to participate in the Contest in accordance with the eligibility criteria specified in point no. 4 of these Terms and Conditions and participating in the Contest are his/hereinafter referred to as the "Participant/s"
To be eligible to play the Contest, the Participant/s need to confirm to following eligibility criteria:
1. an Individual,
2. Indian citizen,
3. residing in India,
4. aged 18 years and above,
5. must have a valid Facebook/Twitter ID
6. participate in the Contest by playing with their Facebook/Twitter ID
To participate in the Contest, a Participant has to visit http://www.facebook.com/KotakMahindra or tweet from his personal Twitter ID
Information as available on the Contest page and Contest Terms & Conditions page is the only authentic and valid information about the Contest. Kotak is not responsible for incorrect / misleading information relating to the Contest, presented / displayed on any source other than the Contest and Terms & Conditions page on http://www.facebook.com/KotakMahindra
Kotak will not be liable for any loss suffered by any Participant based on the representation, terms, conditions, information presented / displayed on any source other than the Contest page and Terms & Conditions page.
To participate in the Contest, Participant/s has to follow the following steps:
1. Log into Facebook or his personal Twitter account from either a computer or mobile phone.
2. If not already a fan of Kotak's official page, http://www.facebook.com/KotakMahindra the Participant needs to 'Like' the Official community of Kotak on Facebook.
3. The user is requested to read the instructions carefully and thereafter proceed to participate on the Facebook tab titled 'Save with Subbu'.
4. The Participant has to enter his 'Smart Saving' tips on Facebook or tweet his Smart Saving tips on twitter with #SavewithSubbu @kotakindia
Participant/s doesn't need to write about Kotak or any of its products/services at all in his/her entries. The subject matter of his/her post is completely upto his/her discretion. No additional merit will be allocated to posts with subject matter being or related to Kotak or any of the products or services provided by Kotak.
Each person who logs onto the application residing on http://www.facebook.com/KotakMahindra is and post their entry(s) or tweets a Smart Saving tip using #SavewithSubbu is assumed to be a ''Participant/s'' for the Contest.
All participants are expected to include the terms #SavewithSubbu & @kotakindia in their tweets.
It is not necessary for the participants to tweet directly to @kotakindia. '@kotakindia' can be mentioned anywhere in the formation of the tweet.
Through the application residing on http://www.facebook.com/KotakMahindra the user can "Tip" (submit their entries), 'Re-Tip' (Share or Re-tweet) Tips Submitted by others.
Once a user has collected 10 Smart Savings tips (original and Retipped) Subbu will look at his entries.
On a daily basis Subbu will go through all entries and 'favorite' the one's he likes.
User's who have their entries 'Favourited' by Subbu may win T-shirts and Gift vouchers depending on the sole discretion of the jury.
The Best tips (entries) from the contest will be featured in Subbu's Smart Savings Book.
Tips 'favourited' by Subbu may be included in Subbu's Smart Savings Book. However it is not necessary that all tips favorite by Subbu will feature in the book.
The final decision to feature tips in Subbu's Smart Savings Book rests with the jury.
Best entries will be announced ‘Winners’ and will receive 1 exclusive Kotak T-shirt each and Gift vouchers daily depending on the discretion of Kotak.
Total score will be sum of: Tips posted by user, Likes received by user, Retips received by user, Likes on others posts made by user and Retips of others posts made by user.
Winners will be announced on the app resting on http://www.facebook.com/KotakMahindra
Winning participants are requested to message their details (Full Name, Full Address & Contact details) to the Facebook Kotak pagehttp://www.facebook.com/KotakMahindra.
The Jury shall announce the name of the Daily Winners on the following day. No winner announcement will be made on weekends. Winners of Friday, Saturday and Sunday will be made on the following Monday.
Jury's decision on the selection to reward the winners or to feature their entries in Subbu's Smart Savings Book, will be final and binding on all the Participant/s.
There is no entry fee or participation fee, payable by the Participant/s for participating in this Contest. Kotak will not accept any form of payment from any of the Participant/s interested in participating in the Contest, further participating in the Contest will not in itself make the Participant eligible for the Prize.
The panel of jury has sole discretion in the interpretation and enforcement of Contest rules, including but not limited to selection of winner and suspension of response(s) or Participants.
The response to this Contest must be original and conform to decency guidelines. Any response deemed to contain content that depicts violence, immoral, unethical, illegal, anti-social, racial, political, anti-religious, sexual or any other inflammatory, defamatory or objectionable material will be disqualified and removed from the application resting on http://www.facebook.com/KotakMahindra.
KOTAK reserves the right to initiate legal action against such Participants. Interpretation of what is, and is not, appropriate material is at the sole discretion of KOTAK.
The Participants should not deface or disparage the brand Kotak in any manner in the process of creating and posting their response.
The Participant cannot create similar response(s) as submitted for this Contest at any other blog/forum or any other/her site, or any other Contest of similar nature.
KOTAK will have no liability, in case someone is not able to participate on account of his inability to access the contest links as provided on the application resting on http://www.facebook.com/KotakMahindra
KOTAK will not be liable for any loss, claim, damage, expenses whether expressed, implied, real, consequential incurred by the Participant due to participation in the Contest.
The prizes are non-endorsable, not transferable and non-substitutable.
KOTAK will entertain no requests for exchange in lieu of the t-shirts and gift vouchers.
Apart from the entitlement to the t-shirts and gift vouchers, the winners and/or their legal heirs will have no other rights or claims against.
Each winner should provide following documents to KOTAK for enabling KOTAK to complete the verification process :

- Phone number/Alternate Contact number,
- Current Address
KOTAK reserves the right to modify, add or delete any of the terms and conditions or participation mechanics of the Contest at any point of time at its sole discretion without serving any prior intimation to the Participants. Intimation of any change, modification, addition, deletion in the terms and condition of the Contest will be served to the participation by posting the revised terms and condition of the Contest Terms & Conditions page.
KOTAK is not responsible for Participant not being able understand the Contest mechanics or for his misinterpretation of the same. No correspondence, clarification, explanation in this regard will be entertained by KOTAK.
Any disputes with respect to the Contest shall be subject to the sole jurisdiction of courts in Mumbai.
KOTAK shall have the right to use the winning entries/name of the winners, in any media for brand, products, business or any other objective as it may deem fit. KOTAK also reserves the right to display the winning entries/name of the winners on any medium (Online, TV etc) or vehicle it deems appropriate.
The Participant shall indemnify KOTAK against any claims from any party and consequent losses, damages, compensation, whatsoever, that may arise from any use, including but not limited to, publication of response (s) submitted by the Participant as a part of, or in association with the Contest.
KOTAK shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, terrorist attack, political unrest, riots, civil commotion, inevitable accidents, acts of God or any other circumstances amounting to Force Majeure.
KOTAK shall not be responsible for any loss or damage if it has to discontinue or cancel this Contest in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The Participant/s shall be informed of such discontinuance/cancellation as soon as possible, through Kotak official Facebook/Twitter Pages.
KOTAK reserves the right to disqualify any Participant/s from participating in the Contest during the Contest Period and/or disqualify any winner/s from winning the t-shirts or gift vouchers after the completion of Contest, if such Participant/Winner violates any of the terms and conditions of the Contest. Any Participant providing any incorrect information or concealing/withholding any information from KOTAK with an intent to participate and/or win the Contest will automatically be disqualified from participating in the Contest and winning the Contest Prize, such act of providing incorrect information or concealing/withholding any information will also include following:
1. Incorrect declaration of age/withholding the information relating to age of the Participant;
2. Incorrect declaration /withholding the information relating to the authenticity of the entry submitted by the Participant.
If any provision of the terms and conditions of this Contest is found to be invalid by any court having competent jurisdiction the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
KOTAK will not be held responsible if the communication pertaining to the winning entries doesn't reach intended participants for any of the following reasons as mentioned:-
- Incorrect e-mail address given at the time of submitting entry
- Inbox of the recipient being full / having insufficient space
- Bandwidth problem of the mailbox / server or the host
- Time lapse
- Any other reason, technical or otherwise, beyond the control of KOTAK.
The participation in this Contest implies unconditional acceptance of all the terms and conditions of the Contest by the Participants.
The aggregate liability of KOTAK, in case of any damage, loss, cost, claim, liability or expense (including legal costs and expenses) caused to or incurred by any act or omission shall not exceed the value of the t-shirts or gift vouchers.
