Terms and Conditions of Samsung Apps App Angel ("Promotion")

By entering this Promotion you (the "Participant") agree to be bound by these terms and conditions. Any information or instructions included on the Samsung Apps Facebook Fan Page (http://www.facebook.com/sansumgapps) ("Fan Page") and App Angel mobile webpage (http://www.my-samsungapps.com/appangel) ("Mobile Page") form part of these terms and conditions. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. The information you provide will only be used for the purposes of operating the Promotion and will not be passed to Facebook. You are providing your information to Samsung Electronics Co., Ltd ("Samsung"), and not to Facebook.

A. Promotion Period

The promotion period is from 09:00 a.m. (GMT) on October 24th, 2012 to 09:00 a.m. (GMT) on November 23rd, 2012. ("Promotion Period") The Promotion may end early if a total number of vouchers redeemed reach 50,000.

B. Eligibility

1. This promotion is open to anyone with a Facebook account who is at least 18 years of age. This promotion shall be void where restricted or prohibited by law.
2. The following individuals are not eligible to enter this promotion:
- (a) Employees, contractors, directors, and officers of the Samsung, its parent, subsidiaries, and affiliated companies, distributors, web design, advertising, fulfillment, insurance agencies, judging, and promotion agencies involved in the administration, development, fulfillment, and execution of this promotion (“Related Persons”);
- (b) The immediate family members (spouse, parent, child, sibling, and spouse or “step-relative” of each) and those living in the same households of each such Related Persons;
- (c) Persons who have breached the terms and conditions of any promotion run by or on behalf of the Samsung.

C. How to enter

1. There is no charge for entering this Promotion. You must have access to the Internet as the Promotion can only be entered online.
2. To enter this Promotion, during the Promotion Period go to Fan Page and select the App Angel (https://www.facebook.com/app_angel) or Mobile Page (https://www.my-samsungapps.com/app_angel) ("Promotion Pages").
3. Select Facebook friends who have Samsung mobile devices and send them a Samsung Apps 5 USD vouchers.
4. There is no limit to the number of vouchers a participant can send, but the participants cannot send more than one voucher to the same friend.
5. Samsung Apps 5 USD vouchers are sponsored by the Samsung and will not be charged to participants.
6. Recipients must provide valid Samsung account and country information before voucher redemption. Vouchers can be redeemed in any designated paid countries with valid Samsung accounts. Equivalent value to 5 USD will be redeemed in the national currency unit. Redeemable voucher value may vary by each country's exchange rate.
7. If currencies are different, the equivalent value to 5 USD will be redeemed in the national currency unit. Actual value may vary per country due to exchange rate.
8. All vouchers must be redeemed during Promotion Period and used by December 31st, 2012.

D. How to win

Five winners will be selected randomly from all participants who send a Samsung Apps 5 USD voucher to one or more friends. Participants will have higher chances of winning as they send more vouchers.

E. The Prize

1. One Samsung GALAXY Note 10.1 (Wi-Fi) will be given to each winner. Total five Samsung GALAXY Note 10.1 (Wi-Fi) will be given through the Promotion.
2. Prizes will be awarded "AS IS" with no warranty or guarantee, either express or implied offered by Samsung. Nothing contained herein should be construed as an endorsement by Samsung of any prize suppliers or other third party, product, or service.
3. No cash or other substitution, assignment or transfer of any prizes permitted, except by Samsung, who reserves the right to substitute a prize or prize component with cash or another prize of comparable or greater value.

F. Notification of Winners

1. Winners will be announced in the Promotion Pages within 5 days after the Promotion ends. An email notification will be sent to the email addresses registered at the time of entry.
2. The winners will have 10 days from the date the email notification is sent to them to claim their prize by sending a reply to the email address from which the notification email from Samsung was received.
3. In the event that a winner is unreachable, ineligible, or fails to claim the prize in the time required, the winner shall forfeit their prize.

G. Publicity

Except where prohibited, participation in the Promotion constitutes winner's consent to Samsung's use of winner's name, prize information, likeness, photograph, voice, opinions, biographical information, hometown, and state for promotional purposes in any media without further payment or consideration.

H. Privacy and Data Protection

1. Other than as set out in these terms and conditions or for the purposes of operating the promotion, the details and information provided by participants when entering the promotion or claiming a prize will not be used for any promotional purposes, nor shall they be passed on to any third parties.
2. Participants' personal information will be kept strictly confidential.

3. Samsung reserves the right to alter, amend, foreclose or withdraw the Promotion or the terms and conditions of entry at its sole discretion at any time and without prior

5. Samsung's failure to enforce any term of these terms and conditions shall not constitute a waiver of that provision.
6. Participation in receipt of benefits from the Promotion may have tax consequences. Should there be any tax liability for participation in the competition or the receipt of a prize, or costs or expenses relating to participation in the competition or for any other reasons, such taxes and/or expenses are the sole responsibility of the participant.
7. This Promotion is governed by the law of the Republic of Korea. All disputes, controversies or claims between the parties arising out of or in connection with this Promotion shall be submitted to the exclusive jurisdiction of Seoul Central District Court of Korea.
8. If you were selected as one of the winners, you are not allowed to use Fan Page wall to post messages to promote and re-sell any of the prizes. By doing so, you will be banned from any future Promotions held by Fan Page.
9. If for any reason the Promotion is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the promotion, the Samsung reserves the right, at its sole discretion to cancel, delay, modify, or terminate the promotion without any prior notice.
10. The Samsung, its agents, and sub-contractors do not accept any responsibility for any technical failure or malfunction or any other problem with any online networked, system, server, provider, or otherwise which may result in any contents or entry into the promotion not being properly recorded or uploaded.
11. The Samsung shall not be liable for any disruption to the promotion, whether due to technical problems or otherwise, which is beyond reasonable control. In the event of any disruption to the promotion, the Samsung shall use its reasonable endeavors to remedy the disruption and resume the promotion on a fair and equitable basis to the participants.
12. The decision of the Samsung is final and the Samsung shall not enter into any correspondence about the results. The Samsung accepts no responsibility for entries lost, misdirected, illegible, late, mutilated or altered. Entries that do not comply with these terms and conditions will be disqualified.
