Terms And Conditions

• By entering this Create Your Smart Style! Promotion (the “Event”; http://apps.facebook.com/samsungsmartpc/) you (the "participant") agree to be bound by these terms and conditions. Any information or instructions included on the Samsung Notebook Facebook fan page (the “Fan page”; http://www.facebook.com/SamsungNotebook) form part of these terms and conditions. This Event is in no way sponsored, endorsed or administered by, or associated with Facebook. The information you provide will only be used for the purposes of operating the Event and will not be passed to Facebook. You are providing your information to Samsung Electronics Co., Ltd (“Samsung” or “Promoter”), and not to Facebook.
• 1. Event Period
     1. The Event period is from 00:00:01 (GMT+9) on November 15, 2012 to 23:59:59 (GMT+9) on January 15, 2013 ("Event Period").
     1. The top six prizewinners will be selected and ranked after two rounds of judging:
        1. Phase 1: Semi-finals: November 15, 2012 to January 15, 2013 (the top 60 people with the most votes during this period will automatically advance to the next round).
        2. Phase 2: Finals: January 21, 2013 to January 25, 2013 (a panel of judges from the Samsung Electronics Design Center will select the top six finalists)
  2. Eligibility
     1. The Event is open to anyone with a Facebook account and over the age of 18 years (or age of majority in the relevant jurisdiction of residence, whichever is older) at the time of entry. This promotion shall be void where restricted or prohibited by law.
     2. The following individuals are not eligible to enter this Event: employees, contractors, directors or officers of Samsung Electronics Co., Ltd. and each of its respective parent, subsidiary and affiliated companies (collectively the “Samsung Parties”); employees, contractors, directors or officers of any web design, advertising, fulfillment, insurance agencies of any Samsung Parties; employees, contractors, directors or officers of any agencies involved in the administration, development, fulfillment and execution of this Event; and the immediate family members (spouse, parent, child, sibling and spouse or “step-relative” of each) and those living in the same households of each such employee, contractor, director or officer.
     3. No purchase is necessary to enter or win this Event.
  3. How to Enter
     1. There is no charge for entering this Event.
     2. You must have access to the Internet as the Event can only be entered online and you must have a valid e-mail address.
     3. You can enter the Event simply by following the below steps:
        3.1 Facebook
        1. Click the ‘Enter’ button on the Event tab provided by Fan page.
        2. Allow the app to access your Facebook profile information (If you do not allow the Event application to access such information, you will not be able to enter the Event).
        3. Access the S Note menu and utilize the feature to design a T-shirt. Once you name and save your design, you will be automatically entered into the Event.
        4. By participating in the Event, you agree to the terms that your entries/submissions become the property of Samsung Electronics.
  4. Prize Information
     1. The top 60 designs with the most votes will become semi-finalists and automatically advance to the next round.
     2. From the pool of 60 semi-finalists, six finalists will be selected and ranked by a panel of judges from the Samsung Electronics Design Center.
     3. Only one design per designer will be selected among the top six designs.
     4. The grand prize winner will receive the Samsung ATIV SMART PC and 10 T-shirts printed with his/her design. Five runners-up will each receive 10 T-shirts printed with their individual designs.
     5. If for any reason, the Samsung ATIV Smart PC is not available, Samsung may substitute a different prize in the same price range without prior notice.
  5. Verification of Winners
     1. Samsung will select six winners from all eligible entries received during the Event Period. The selection is final and binding in all matters related to the Event and cannot be appealed. Entries that do not comply with these Terms and Conditions will be disqualified.
     2. A winner will be notified through the e-mail provided in their individual Facebook account.
     3. A winner will must confirm his or her postal address to Samsung via email within 48 hours of receipt of notification or forfeit the prize. Samsung will then email the second runner up candidate, who will have the same amount of time to claim his or her prize.
     4. Once a winner is confirmed pursuant to the above procedures, a general announcement of the winner shall be made on the Samsung Fan Page.
     5. In the Event that a winner is unreachable, ineligible, or fails to claim the prize in the time required, the winner shall forfeit his or her prize.
  6. Publicity
     1. Except where prohibited, participation in the Event constitutes winner's consent to Promoter's use of winner's name, prize information, likeness, photograph, voice, opinions, biographical information, hometown, and state for promotional purposes in any media without further payment or consideration.
  7. Privacy and Data Protection
     1. Other than as set out in these terms and conditions or for the purposes of operating the Event, the details and information provided by you when entering the Event or claiming a prize will not be used for any purpose other than to notify winners and for prize fulfillment purposes in connection with the Event Promotion, nor shall they be passed to any third party.
     2. Participants' personal information will be kept strictly confidential.
  8. Release
     1. By receipt of any prize, winner agrees to release and hold harmless Promoter and any promotional partners, each of their parent, subsidiary, affiliate, and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) from and against any losses, damages, rights, claim, or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Event or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Event, including without limitation personal injury, death, and or property damage, as well as claims based on publicity rights, defamation, and or invasion of privacy.
  9. Limitations of Liability
     The Released Parties are not responsible for:
     1. any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Event;
     2. technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, or network hardware, or software;
     3. unauthorized human intervention in any part of the entry process or the Event;
     4. technical or human error which may occur in the administration of the Event or the processing of entries.
  10. General Conditions
      1. Promoter reserves the right to alter, amend, foreclose or withdraw the Event or the terms and conditions of entry at its sole discretion at any time and without prior notice.
      2. By entering this Event, you agree to these Terms & Conditions as well as Samsung’s Privacy Policy (which can be found at www.samsung.com) which are final and binding in all respects related to the Event.
      3. The Promoter reserves the right, at its sole discretion, to disqualify any participants deemed to be
         1. tampering or attempting to tamper with the entry process or the operation of the Event or any website of the Promoter’s partners;
         2. violating these Terms and Conditions;
         3. acting with intent to annoy, abuse, threaten or harass any other person.
      4. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Event is a violation of criminal and civil law, and, should such an attempt be made, Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. Promoter's failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
      5. Participation in receipt of benefits from the Event may have tax consequences. Should there be any tax liability for participation in the competition or the receipt of a prize, or costs or expenses relating to participation in the competition or for any other reasons, such taxes and or expenses are the sole responsibility of the participant.
      6. This Event is governed by the law of the Republic of Korea. All disputes, controversies or claims between the parties arising out of or in connection with this Event shall be finally resolved by arbitration to be held in Seoul, Korea and conducted in English under the Rules of Arbitration of the International Chamber of Commerce. The arbitral award shall be final and binding on the parties.
      7. If you were selected as one of the winners, you are not allowed to use Fan page wall to post messages to promote and re-sell any of the prizes. By doing so, you will be banned from any future Event held by Fan page.
