The following govern the ‘Win Hearts this Diwali’ contest (hereinafter referred to as ‘Contest’) and sets out the terms and conditions among the Contest Organizers [Western DigitalTechnologies, Inc. and its affiliates (hereinafter referred to as ‘WD’) and Momentum Communications (INDIA) Private Ltd (hereinafter referred to as ‘MCIPL’), &Text 100 PR Group (herein after referred to as ‘Text 100’), collectively known as ‘Contest Organizers’] and each participant/contestant/entrant/you (‘Contestant’). A submission to this Contest constitutes your acceptance of the following terms and conditions:

1. Eligibility: This Contest is only open to residents of India. All national and local laws and regulations of India apply. Contestants must be 18 years of age or older to participate in this Contest. Employees, officers and representatives (and members of their immediate families and those living in the same household of each) of Contest Organizers, its parents, subsidiaries and affiliated companies, advertising and promotion agencies and any company involved in the design, execution, production or judging of this promotion (“contest entities”) are ineligible. Void where prohibited 

2. No Purchase Necessary; Free Entry: Entry to the Contest is free of any charge or cost and the Contestant is not required to pay any money or money equivalent to gain entry to the Contest. 

3. Content Ownership and Publicity: Contest Organizers and Facebook shall not be subject to any liability due to any entry submitted under the Contest; but by submitting an entry, you are granting WD the following worldwide, non-exclusive, perpetual, irrevocable, royalty-free, unconditional, fully paid-up rights: (i) to make, have made, use, copy, reproduce, modify, and create derivative works of the contributions, (ii) to publicly perform or display, import, broadcast, transmit, distribute (directly and indirectly through multiple tiers), license, offer to sell and sell, rent, lease, or lend copies of the contributions (and derivative works thereof), (iii) to sublicense to third parties the foregoing rights, including the right to sublicense to further third parties, and (iv) to publish your name or alias in connection with this Contest and your contributions.

Contestants understand and agree that their submission(s) may be posted and publicly viewable. By providing submission(s), you grant Contest Organizers and their affiliated companies the right, except where prohibited by law, to use your name for promotional purposes in promoting or publicizing the Contest or productsof the Contest Organizers. Contest Organizers, however, do not have any obligation to use the winning entries for any purpose.

4. General Terms of the Contest:To enter the Contest, a Contestant must (i) ‘Like’ the WD India Facebook page (located athttps://www.facebook.com/westerndigitalindia) (‘WD India Facebook’); (ii) register for the Contest at [http://www.momentumdigital.co.in/] (‘Website’); and (iii) play the WD Card game posted on the Website for the Contest (‘Contest Game’).

Contest Organizers will support twenty five (25) girl child’s education for a year.The support towards the children’s education shall be done within one month after the Contest Period, in association with Smile Foundation a Public Charitable Trust,working in the field of Education, Health, Livelihood & Women Empowerment. 

An eligible Contestant is allowed to submit an entry into the Contest only once during the Contest Period. An eligible Contestant may only attempt to play the game once during the Contest Period. The ‘Contest Period’ shall commence on 6th Nov 2012 at [08:00 am [Indian Standard Time GMT + 5.30] and end on 19th Nov 2012 at 5:00pm [Indian Standard Time GMT + 5.30]. 

Entries to the Contest shall be only accepted through Website and shall not be accepted through any other mode. The Contest is not sponsored, endorsed or administered by, or associated with, Facebook.The information provided by the participant is to Contest Organizers and not to Facebook.

5. Prizes: Each eligible Contestant that registers for the Contest and finishes the game successfully shall be entered into a prize drawing (‘Prize Drawing’). The winners shall be decided by lucky draw amongst all eligible Contestants who register and finishes the game successfully (‘Eligible and Correct Entries’). There will be fifteen(15) total winners selected from Eligible and Correct Entries, each of whom will receive one (1) WD My Passport 500 GB External Hard Drive worth MRP INR 6,500 (Indian Rupee Six Thousand and Five Hundred).Total aggregate value of all prizes to be awarded in this Contest is INR 97,500 (Indian Rupee Ninety Seven Thousand and Five Hundred) approximately 

The winners may be required to complete an Eligibility Confirmation and a Liability/Publicity Release form. The Confirmation and the Release must be returned within ten (10) days of receipt of these documents. Non-compliance with any of these requirements may result in disqualification, in which case an alternate winner may be chosen. Physical prizes will be sent to participants within forty (40) days from the date of the return the completed Affidavit of Eligibility and/or Liability/Publicity Release. Winners will be notified via the contact detail provided within fifteen (15)days from judging. If after seven (7) days of the second notification to the winner no acknowledgement or response is received the prize is forfeited, and Contest Organizers will select another winnerby random drawing of the remaining Eligible and Correct Entries. 

The Contest Organizers reserve the right to qualify/disqualify any entry if information provided by the Contestant is proven to be false and/or inadequate 

The Contest Organizers may refuse to give prizes or reclaim all prizes awarded to the winners in the contest if his/her fraud, dishonesty or non-entitlement to participate in the contest under the rules, come to light. 

If a prize becomes unavailable due to any reasons or is prohibited by law, Contest Organizers may at their sole discretion award a substitute prize of equal or similar value. The winner accepts responsibility for all federal, central, state and local taxes and fees in connection with receipt and use of the prizes. 

Apart from prizes offered as part of the contest, no monetary compensation will be paid for any of your contest submissions. Contest Organizers are not responsible for the contest entries/submission(s) not received due to lost, failed, delayed or interrupted connections or miscommunications, or other electronic malfunctions. Contest Organizers are not responsible for incorrect or inaccurate entry information, whether caused by you or any other persons or by any of the equipment or programming associated with or utilized in the contest.

6. Contest Organizer’s Warranties and Disclaimers: Contest Organizers and Facebook do not provide any warranty on the prizes awarded, and winners should look solely to the applicable manufacturers for warranty. To the fullest extent allowable by law, Contest Organizers and Facebook specifically disclaims any representations or warranties, express or implied, regarding the Contest or the prizes including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance.

7. Release of Liability and Issues of Law: By participating, all Contestants release Contest Organizers and Facebook, and their respective affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this Contest from any and all liability with respect to and in any way arising from participating in this Contest, and acceptance or use of prizes. Contestants also agree that Contest Organizers and Facebook, and their respective affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this promotion are not responsible or liable for any injury or damage to an entrant's or third person's computer related to or resulting from the Contest, the submission and/or its prizes. Contest Organizers and Facebook are not liable for damage to a user's computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an entrant's participation in the Contest or downloading of information in connection with the Contest. Contest Organizers reserves the right to modify or cancel the Contest in the event that any portion of any website used to administer any aspect of the Contest becomes technically corrupted.

Contest Organizers are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Contest Organizers on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest or downloading any materials in this contest

THE DELHI COURTS SHALL HAVE SOLE JURISDICTION OVER ANY DISPUTE REGARDING THE CONTEST AND THE LAWS OF INDIA SHALL GOVERN THE CONTEST. EACH ENTRANT/PARTICPANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. THE CONTEST IS VOID WHERE RESTRICTED OR PROHIBITED BY LAW.

If Contest Organizers denies you any eligible prize(s), Contest Organizer’s entire liability and your sole and exclusive remedy will be limited to distribution of the equivalent amount of prizes as set forth above. By participating in the Contest, you waive any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based. 

8.Use of Data: Contest Organizers will be collecting personal data about Contestants as part of this Contest. Please review WD’s privacy policy here. By participating in this Contest, entrants hereby agree (i) to Contest Organizers collection and usage of their personal information and acknowledge that they have read and accepted WD’s privacy policy and (ii) to allow WD to periodically send notification of special offers and promotions via e-mail. If at any time you decide that you do not wish to be contacted further about special promotions via e-mail, follow the instructions in the e-mail. If you are located outside the United States, please note that your personal information may be transferred, stored and processed within the United States. The data protection laws in the United States may not be as comprehensive as those in your country. By entering this Contest, you are consenting to the transfer of your personal information to facilities located in the United States and other facility locations selected by Sponsor.

9. Generally: These terms and conditions apply to your submissions/contributions, unless Contest Organizers provide any items to you under more specific terms, in which case those more specific terms will apply to the relevant items. Contest Organizers may make changes to these terms and conditions at any time without notice to you. Contributing to the Contest or accepting prizes will constitute acceptance of the revised terms and conditions. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

If, for reasons beyond Contest Organizers control (including, but not limited to, tampering or computer virus infection), the Contest is not capable of running as originally planned, Contest Organizers, at its sole discretion, reserves the right to cancel or modify the Contest, without any liability. Contest Organizers will not be responsible for lost, late, misdirected, damaged, or illicit submissions, or for Internet, computer hardware and software, phone, and other technical errors, omissions malfunctions, and delays. Entries are void if they contain material typographical or other errors. All Contestants agree to comply fully with each provision in these terms and conditions. Any person attempting to defraud or in any way tamper with this Contest and any person who does not comply with these terms and conditions, will be ineligible for any prize(s) and may be prosecuted to the full extent of the law.
