Vodafone “Share & Win” Competition - Terms & Conditions
1. The “Vodafone Share & Win” competition (“Competition”) is organized jointly by
Vodafone India Limited, Vodafone Mobile Services Limited, Vodafone West Limited,
Vodafone East Limited, Vodafone South Limited, Vodafone Digilink Limited,
Vodafone Cellular Limited and Vodafone Spacetel Limited (hereinafter referred to as
‘Organizer’ or “Vodafone India”).
2. This Competition will be held from 14
th
November 2012 00 hours India Standard Time
(“IST”) till 6
th
December 2012 00 hours IST (“Competition Period”), and there is no
entrance fee for participating.
3. This Competition is open only to:
(i) individual residents of India, who are over 18 years of age and
(ii) active subscribers of Vodafone services in Andhra Pradesh, Assam and
North East, Bihar, Delhi, Gujarat, Haryana, Rajasthan, Karnataka, Kerala,
Kolkata, Maharashtra, Goa, Madhya Pradesh, Mumbai, Orissa, Punjab and
Himachal Pradesh, Uttar Pradesh East, Uttar Pradesh West and West
Bengal.
4. The Competition will work in the following manner:
i. A Vodafone India subscriber has to log on to an app accessed via Facebook
page managed by Vodafone India (facebook.com/zoozoo) during the
Competition Period
ii. On the Facebook app (“App”) the subscriber will get points for certain
selected action he or she performs (for e.g. watching a video will give points,
sharing a video will give points, etc.)
iii. The subscriber with the maximum points will be adjudged the “Winner” at the
end
iv. The Vodafone India subscriber has to register his/her details in the form at
the end
v. Only one entry is allowed per person (The identity of a customer will be
determined on the basis of all or any combination of the following: name,
mailing address, e-mail address, IP address, computer, and any other forms
of identification which may be required). Anyone posting multiple entries will
be automatically disqualified. Once an answer has been submitted it cannot
be changed in any way
vi. The winners of this Competition would be selected out of the participating
Vodafone India subscribers based on the number of points gathered at the
end of the Competition Period. Totally, 121 winners will be chosen
vii. In case there are multiple Vodafone India subscribers with the same score at
the end of the Competition, then the winners will be selected randomly in the
presence of an independent auditor
viii. Mere participation in the Competition does not entitle the participant to be
selected as a prize winner.
5. There will be 121 prizes for the participants. The first prize will be a Samsung Galaxy
Tab 2.
6. Organizer reserve the right to change the prizes at any time. Organizer also reserves
the right to announce other prizes to participants in the Competition.
7. To participate in the Competition, the Vodafone India subscriber must participate
through facebook.com/Zoozoo and enter as per the process outlined on the
Facebook app.
8. Organizer will verify authenticity of the participating Vodafone India subscribers and
check whether the records and other details provided are in order. Post successful
validation of the selected Vodafone India subscribers, the Organizer will forward 2
names and other relevant details of the eligible participants to the competent
independent auditor for selecting the suitable winners.
9. Winners will be intimated on their Vodafone number or via email or on Facebook or
by post or such other mode, as may be suitably determined by the Organiser. In the
event, Organizer is not able to establish successful contact with a winner, that winner
shall not be considered for the prize, and Organizer may choose any other prize
winner, at its sole discretion.
10. Winners should collect their prize within 5 days after intimation by post or in any other
form as may be suitable conveyed by Organizer, failing which the prize/s will lapse
automatically.
11. The winner can be considered as disqualified for the prize in case he/she fails to clear
all outstanding dues payable to Vodafone India and / or is not a valid/active Vodafone
India subscriber on the date of claiming the prize.
12. Any local levies, taxes, duties or any other statutory liabilities associated with the
prize will have to be solely borne by the winner. The winners Permanent Account
Number (PAN) and other details would be taken for record. Compliance with respect
to statutory obligations/taxes will be the responsibility of the winners.
13. Organizer shall not be liable for any defect/s in the prize/s, and makes no
representation or warranty, of any kind, to the participants or any third party, and
hereby expressly disclaims all warranties, express or implied including, but not limited
to, any implied warranty of accuracy, timeliness, completeness, merchantability or
fitness for particular purpose. Vodafone India shall not be liable or responsible for any
loss/damage to the prize/s during transit.
14. The prize/s offered for the Competition are not encashable or transferable or
exchangeable under any circumstances by any of the winners.
15. Organiser will not be responsible under any circumstances for any technical snag, or
error, or delay, or inability of Vodafone India subscriber to access the microsite, or
loss of answers to the question/s on the microsite. Any unclear/incorrect/incomplete
answers, including answers with wrong characters shall be considered invalid entry
and deemed null and void.
16. Organiser will not be responsible under any circumstances for any technical snag or
delay or loss in receipt of SMS questions that may have been sent to Vodafone India
subscribers under this offer or in receipt of the answers to the SMS questions from
such Vodafone India subscribers.
17. The Vodafone India subscriber / winner hereby irrevocably authorize the Organizers
that their data or information gathered during the Competition Period shall be the
property of Vodafone India and Vodafone India shall be entitled to use the same in its
communications including, marketing promotions and advertisements, along with or
without Vodafone brand, without any further consent or permission from the Vodafone
India subscriber / winner. By entering into the Competition, the winner/s waive all
copyrights, rights of publicity and any related rights, and consents to Organizer’s right
to picture, tape or portray him/her as a Competition winner, and to exhibit this
material in any and all media now existing or hereinafter created, including without
limitation television, film, radio and print media, without any compensation
whatsoever for advertising and publicity purposes, except where prohibited by law.
18. The employees of Vodafone India and its affiliates, subsidiaries, assignees,
representatives and their immediate families are not eligible to participate in this
Competition.3
19. Organizer’s selection of the winner/s of this Competition will be final and binding on
all participants. No personal queries as to the results of this Competition will be
entertained
20. Under no circumstance shall Vodafone India, or its affiliates, or subsidiaries, or their
directors, employees, officers, agents or representatives, be liable to the participant
and/or any third party for any loss of profits or loss of opportunity, incidental, indirect,
consequential, special, exemplary or punitive damages whatsoever, even if they have
been advised of the possibility of such damages.
21. All disputes are subject to Mumbai courts jurisdiction only, to the exclusion of all other
Courts in India
22. Organisers reserve their absolute right to cancel, change or modify or alter any of
terms and conditions of the Competition, without notice, at any given time. The
decision of Organizers with regard to genuineness of any claim shall be final and
binding and no claim / correspondence shall be entertained in this regard.
23. Participant agrees that participant has read, understood and voluntarily agreed to
these terms and conditions.
