Terms And Conditions

1. Samsung India Private Limited's, "Galaxy Y Duos lite - Hunt" Contest (hereinafter called the "Program") shall run on Facebook; wherein each participant shall be called "Contestant"
2. Details of the Program:
   The Program will be effective from 8th December 2012 till 15th December 2012.
   
   • This Program requires the Contestant to answer all questions asked, correctly.
   • The Contestant will be shown one question at a time and has to select one of the multiple choice answers put forth.
   • The Contestant can participate multiple times but can only play up to a maximum of 4 times in a single day
   • Only those Contestants who have answered all questions correctly will be eligible to win the one of the following (hereinafter called the "Prize")
     • Grand Prize: Trip to Gangtok (Return air ticket + Hotel stay in Gangtok for 2 pax)
     • Weekly Prize: 1 Galaxy Y Phone every week
     • Daily Prize: 1 couple movie ticket every day
   • The Daily Prize Winner will be selected on the basis of the most accurate options/location chosen by the Contestant.  
   • The Weekly Prize Winner will be the Contestant who has participated the most number of times and with the highest level of accuracy in the period of a week. 
   • The Grand Prize Winner will be the Contestant who has participated the most number of times and with the highest level of accuracy throughout the period of the Contest.
   • In cases where multiple Contestants are tied for the Prize, the winner will be selected by a lucky draw. 
   • Please note that answering all questions correctly does not guarantee the Contestant wins a Prize.
   • SAMSUNG INDIA PRIVATE LIMITED holds the right to select the winner.
3. Eligibility criteria for participation in the Program:
   • The Program shall be applicable for individuals who are:
     1. Residents of India.
     2. Persons having age of 18 (Eighteen) years or above
   • The following individuals are not eligible to participate in the Program:
     1. Employees of SAMSUNG INDIA PRIVATE LIMITED
     2. Employees of Cheil Worldwide.
     3. A winner of this contest is eligible for the prize once & cannot claim for the same again during the entire contest duration. However, the winner may play the game again.
   • The Program ends at 11:59p.m on 15 December, 2012: Participation after this time will not be considered as an entry into the contest and shall not be considered for the Prize.
4. SAMSUNG INDIA PRIVATE LIMITED reserves the right to cancel, change or substitute the Prize or any of these terms at any time without any prior notice.
5. The Prize will be delivered within 45 days from the date of announcement of the Winner. SAMSUNG INDIA PRIVATE LIMITED shall not be held liable for any delay in delivery of the Prize due to non-availability of stocks or any other reason beyond its control. The Contestant shall not have any rights to claim, loss or costs from SAMSUNG INDIA PRIVATE LIMITED for delay in delivery of the Prize on any grounds whatsoever.
6. The Prize is not exchangeable for any other product or item, is non transferable and cannot be encashed under any circumstances. The decision of SAMSUNG INDIA PRIVATE LIMITED in respect of colour/model of the Prize shall be final and no dispute shall be entertained in this regard. The actual Prize may vary from the image shown in the program. Warranty as per standard warranty terms & conditions of SAMSUNG INDIA PRIVATE LIMITED shall be applicable on the Prize i.e.
7. Contestant hereby agree and undertake not to hold SAMSUNG INDIA PRIVATE LIMITED and/or or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses that Contestant may/might have suffered, sustained or incurred, or claims to suffer, sustain or incur, by way of and /or on account of the Program or by participating in the Program.
8. This Program is subject to force majeure conditions that are beyond the control of SAMSUNG INDIA PRIVATE LIMITED.
9. The Program cannot be combined with or clubbed with any other scheme and/or offer from SAMSUNG INDIA PRIVATE LIMITED, subsisting or announced at a future date by SAMSUNG INDIA PRIVATE LIMITED.
10. SAMSUNG INDIA PRIVATE LIMITED reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this Program or any part thereof at its sole discretion at anytime during its validity and without notice, as shall be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and/ or force majeure events and the same shall be binding on the Contestant.
11. Suspected or actual fraud and/or suspected or actual abuse relating to the Program, by the way of fake or duplicate profile or profiles may result in termination of Contestant participation in the Program in addition to any other rights or remedies SAMSUNG INDIA PRIVATE LIMITED shall have whether in law or equity against Contestant.
12. Failure by SAMSUNG INDIA PRIVATE LIMITED to enforce any of its rights at any stage against Contestant does not constitute a waiver of those rights.
13. Except for any liability that cannot be excluded by law, SAMSUNG INDIA PRIVATE LIMITED (including its Directors, officers, employees and agents) excludes all liability for any loss or damage, whether direct, indirect, special or consequential, arising in any way out of the program.
14. If any terms and condition of the program found to be unlawful, void or for any reason unenforceable, that provision will be deemed severable from these terms and conditions and will not affect the validity and enforceability of any remaining provision, unless it is practically not possible to administer the program.
15. Decision of SAMSUNG INDIA PRIVATE LIMITED on all aspects including with regard to administering the Program shall be final and binding on the Contestant.
16. In case of any issues related to the Program, Contestant shall e-mail their query to officialsamsungin@gmail.com.
17. Participation in this Program shall be construed as an acceptance of the Terms and Conditions stipulated herein and of any rules and regulations already announced.
18. The terms and condition of the program shall be governed by Indian Laws. Any and all disputes, controversies and conflicts ("Disputes") arising out of the program shall be referred for Arbitration to a sole arbitrator to be nominated by Sr. Vice President of SAMSUNG INDIA PRIVATE LIMITED and the decision of the said Arbitrator shall be final and binding on all. The place of arbitration shall be New Delhi and the language used in the arbitral proceedings shall be English. Subject to the dispute resolution procedure as set out hereinabove, the Courts at New Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the program.
