Terms & Conditions

The Contest (“Contest”) is open to all people who are citizens of India and above 18 years of age (“Participant”).These terms and conditions contained herein govern the terms of participation in the Contest. Participants entering the said Activity shall be deemed to have accepted these terms and conditions.

This document is an electronic record in terms of the Information Technology Act, 2000 and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

 Participants need to play the game on the application and answer the slogan on www.facebook.com/Aircel . After qualifying with a minimum game score, seventeen(17) entries will be selected by a panel of judges constituted by Aircel. Three (3) prizes will be given out and announced at the end of every two days. Four (4) weekly prizes will be announced at the end of the week. One (1) Bumper prize will be given out and announced at the end of the Activity. All participants who participate in Contest on www.facebook.com/Aircel (“Web Portal”) hereby agree with the terms & conditions as mentioned below and undertake to abide unconditionally by the same.

HOW TO PARTICIPATE:

1. Participant who logs on to Web Portal; can participate in this Contest.
2. The contest is free. However, the Participant shall have to pay their respective access provider/internet service providers, the applicable charges for accessing the internet and uploading the posts.
3. The copyright liability of a slogan, if any, shall be borne by the Participant alone.
4. The Participant shall ensure that the slogan(s) is/are true and genuine and is not obscene, threatening, harassing, libelous, deceptive, fraudulent and invasive of another's privacy, offensive, defamatory of any person or otherwise illegal. Participant warrant that the content he/she submit to the Application does not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary or privacy right of any party or individual. Participant agree not to (i) post content which is deliberately intended to upset or harm other users; (ii) use the Application to post or otherwise transmit content that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of any impermissible classification, including, without limitation, religion, gender, sexual orientation, race, colour, creed, ethnicity, national origin, citizenship, age, marital status, military status or disability; (iii) post or otherwise transmit any content that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of the Application or any telecommunications equipment; (iv) upload or otherwise transmit any content, or take any other actions with respect to Participant’s use of the Application, that would constitute, or would otherwise encourage, criminal conduct or give rise to civil liability; or (v) use the Application for commercial purposes, including, without limitation, submitting any material to solicit funds or to promote, advertise or solicit the sale of any goods or services.
5. Invalid entry or abusive entry or incomplete entry(s) which limit Aircel rights under this terms and conditions by Participant may be rejected by the Panel or Aircel. The decision of any entry due to its invalidity or abusive nature or incompleteness shall be solely decided by Panel and/or Aircel, and may be communicated to the participants, and any such decision shall be final and binding on the said Participant.
6. The Participants to the contest agree that Aircel is only reproducing the slogans  uploaded on the Web Portal , and that Aircel has the power to remove any such uploaded content deemed inappropriate from the  Web Portal  either itself or with the support of the website operator or by taking appropriate legal action (civil or criminal).
7. All Aircel employees, distributors, channel Partners, Directors, or any other person likewise directly related to Aircel or this promotional event, their close relatives are not eligible to participate in this Contest, for which Aircel, in its absolute discretion, shall determine the eligibility of any such participant falling within the category of personnel as stated in this clause. Such decision shall be final and binding on the participant of this Contest.
8. Participation time: This is a limited period Contest. All participants can posts their messages for the Contest from 14:00 hours dated 28th November 2012 till 23:59:59 hours on 26th December 2012.
9. Notwithstanding anything stated herein, AIRCEL reserves the right to stop the Contest at any time and/or change, modifies, withdraw, or extend the Contest without any prior notice and no correspondence in this regard shall be entertained. Aircel reserves the right to withdraw/change / modify the content and terms and conditions at its own discretion and without any prior notice and / or assigning any reason. Therefore, Participants are advised to regularly check for any amendment(s) or update(s) of the terms and conditions at   http://facebook.com/aircel
10. The participants, who win this contest as Winners, then such Winners will be communicated through a confirmation call or an e-mail. Neither during the contest or thereafter, shall the Participant be entitled to hold Aircel responsible for any loss occurred during the participation, as Participant understands all the terms and conditions of this Contest and has entered this Contest at its own sole discretion and free will.
11. Winner, if required by Aircel, agree to participate in image photos, video shoots and/or film shooting sessions so required for any Aircel’s advertisement, promotional or otherwise related purpose. Winner hereby agree that Aircel shall have the right to use such photos, videos and/or films in any medium of communication (including, without limitation, print, press, internet or any multi media medium) and in any reasonable manner as Aircel may decide in its sole discretion. Aircel shall ensure that such use of Winner image photo, video and/or film shall be free from any vulgar, obscene, misleading, defamatory, derogatory or libelous depiction. The names, addresses, telephone numbers, e-mail identities and/or photographs of Winner may be used by Aircel for sending out commercial information and/or for other commercial, publicity or promotional purposes.
12. By participating in Contest, subscriber-participant warrants that he/she participating in this Contest is voluntarily and all information submitted by him/her/it, is true, current and complete.
13. Aircel at its own discretion can accept or reject any entries /Winner and no objection in this regard shall be entertained including but not limited to non-compliance with the Aircel ‘Customer Application Form (CAF)’ conditions, lack of subscriber address verification, ID verification or failure to comply with the terms and conditions stated herein, etc.
14. By participating in Contest, participant warrants that he/she participating in this Contest is voluntarily and all information submitted by participant, is true, current and complete.
15. Aircel at its own discretion can accept or reject any entries /Winner and no objection in this regard shall be entertained including inability to contact the Winner, incorrect phone number, incorrect email id, or incorrect address or failure to comply with the terms and conditions stated herein, etc. If the winner is not contactable on mobile number or email and no revert from the winner is received within seven (7) days after first attempted notification, Aircel may at its sole discretion give the winning prize to the next declared Winner and the original winner's entitlement to the prize will lapse.
16. Prizes, if any received under Contest by any winning Participant cannot be transferred to any other person.
17. Prize is not cashable by Winner. All applicable government taxes/duties if any on prizes are to be borne by the winners.
18. Prizes cannot be substituted for other articles or cash by Winner.
19. All decisions of Aircel in relation to Contest shall be final and binding upon participant and Winners. No correspondence or objection shall be entertained in this regard.
20. Participant has read and agreed to all the terms and conditions of this Contest with his/her free will.
21. Contest shall be subject to the laws of India.
22. All or any dispute arising hereof between Aircel and subscriber-participant shall be subject to the courts jurisdiction of Chennai.
23. Notwithstanding anything stated herein, Aircel shall not be liable for any failure to perform any or all of its obligations hereunder is due to or attributable to acts, events, omissions or accidents beyond the reasonable control of Aircel, including but not limited to act of God, fire, lockout, strike or other official labour dispute, union problem, riot or civil commotion, terrorism, satellite failure, failure of technical facilities act of public enemy, enactment, rule or order or act of government.
24. Aircel shall reserve the right to use all data, material etc. received from participants as part of this Contest as it may deem fit. The winner(s) will also be required to participate in promotional Activities/events organized by the Aircel, as and when required at the discretion of the Aircel.
25. Participant(s) who breach the terms, in any manner, shall be disqualified from the Activity and Aircel may take legal action against them.
26. Aircel expressly disclaims all warranties of any kind, whether express or implied. Aircel shall not be responsible for sub-standard quality or any defects of any nature in the Prize/product supplied by manufacturers, including any damages done in transit. Any claim in respect of any product is a subject matter of the product manufacturer and all enquiries for warranty / defect related claims or disputes shall be directly settled between the Winner and the manufacturer.
27. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook Participant(s) are providing their picture/information to the Company and not to Facebook voluntarily. The Company shall reserve the right to use all data, material etc. received as part of this Contest as it may deem fit for its future promotions without any consideration and the Participant(s) shall have no claim or objection and/or dispute in this regard.
28. In the event of any discrepancy or inconsistency between these terms and conditions and any broachers, marketing or promotional materials relating to promotion these terms and condition shall prevail.
29. Aircel will in no event be liable for any damages - direct, indirect, special, incidental, or consequential arising out of the Contest or use of the prizes given through the Contest
