- CONTEST: Center Fresh Gum Chardes Contest is conducted by Perfetti Van Melle India Private Limited (“PVM India”) having its registered office 47th Milestone Delhi – Jaipur Highway, Manesar 122050 , Gurgaon (Haryana) and corporate office at 1st Floor ,Tower A, Global Business Park, MG Road, Gurgaon – 122002 (Haryana). Before participating in the contest, please read the terms and conditions given here.
- Contest Period: The contest shall run for the whole of campaign period commencing from 10th September 2013 at 00.00 hours in the morning and concluding on 04th November 2013 at 23.59 hours in the night (both days inclusive). For the purpose of this contest, first month shall commence from 10th September 2013 and end on 7th October 2013 and second month commences from 8th October 2013 and end on 4th November 2013. Week shall mean
- Any entry for the contest before 10th September 2013 (00.00 hours in the morning) and after 4th November 2013 (23.59 hours in the night) shall not be entertained and summarily rejected.
- Eligibility: Participant(s) must be a citizen of India; residing in India. Residents of other countries and non- Indian citizens are not eligible to participate. The Employees, agents, associates and promoters of PVM India and of its affiliates, subsidiaries and advertisement agencies (including their immediate family members) and all others directly associated with organising the contest(s) are not eligible to participate.
- No purchase of either Center Fresh or any other product sold by PVM India is required to participate in the contest. No charges are payable to PVM India or the organisers to participate in or win the contest. The contest(s) are not being conducted with a view to earn profit or promote the business or sales of PVM India and are intended to invoke interest in product advertisement.
- To participate in the contest, the Participant (the
“Participant(s)”) must submit the answer to the video shown on the
website www.centerfresh.in/gumcharades or on the Facebook page in the manner as given below:
- i)Through website:
- a) visit website www.centerfresh.in/gumcharades
- b) watch video, submit movie name, register yourself by filling in all the mandatory fields shown on the webpage which include Name, User Id, Password, Phone number and Email of the Participant and submit.

For easy reference of the participants, steps on how to make an entry through Facebook are enclosed as Annexure I.
- There will be 1 bumper prize, 03 mega prizes, 06 monthly prizes and 40 weekly prizes in total. The prizes* will be as under:
- A) The criteria for selection of winners will be as follows:
- Bumper Prize Selection: Only one participant with the highest score on the leader board at the end of the whole campaign period will be recognised as the winner of the Bumper Prize.
- Mega Prize/s Selection: There will be three (03) mega winners. The 2nd, 3rd and 4th highest scorer on the leader board at the end of the whole campaign period will be recognised as the winners of the Mega Prize.
- Monthly Prize/s Selection: There will be three (03) monthly winners in each month. Top 3 scorer (1st, 2nd and 3rd highest score) on the leader board at the end of first and second month each will be recognised as the winners of the Monthly Prize. Participants recognised as first month’s winner shall not be eligible for second month’s prizes but he/she may be eligible to win Bumper and Mega prize.
- Weekly Prize/s Selection: There will be five (05) weekly winners in each week.
- a) Top 2 scorers (1st and 2nd highest score) on the leader board at the end of each week will be recognised as the type 1 winners.
- b) Next top 3 scorers (3rd, 4th and 5th highest score) on the leader board at the end of each week will be recognised as the type 2 winners.
- The tentative dates for declaration of prize winner(s) are as per below schedule:
- The Prize Winner for the each contest will be notified by PVM India or its Agency at the e-mail id as provided by them. PVM India and its agents or representatives will use their best efforts to contact the prize winner(s). The name of the prize winner(s) will be announced on the Website www.centerfresh.in/gumcharades . PVM India/Agency shall not responsible in any manner whatsoever in regard to contest and/or for non receipt of any communication due to network failure, network congestion, network unavailability or any other technical issue or event/incidence not within the control of PVM India/Agency. In case the prize winner for a contest cannot be contacted even after two (2) attempted mail intimation within seven (7) days from the date of declaration, the selected prize winner will stand disqualified and the next eligible prize winner for the contest will be selected by the Agency/PVMI as per the selection criteria . If the original Prize Winner for a contest is disqualified for this or for any other reason, such as being found ineligible or indulging in fraudulent practices or failing to comply with all these terms and conditions, then the next eligible highest scorer will be declared winner and will be entitled to the prize instead, according to the aforementioned selection procedures.
- The prize(s) will be awarded to the prize winner(s) after due verification and in accordance with the terms and conditions stated herein. The prize winner(s) shall, prior to collection of the prize, be required to submit to PVM India or Agency, valid ID proof, residence proof, PAN and/or any other document as specified by PVM India/Agency. The participant agrees to submit an affidavit in the prescribed format as to satisfying all the terms and conditions, tender evidence, if so required by PVM India. For valid ID proof as well as residence proof, any two of the following may be submitted: a) Passport, b) Voter ID c) Driving License d) UID/Aadhar Card e) Nationalised bank passbook with photograph. In case the winner is less than 18 years of age, the gratification may be awarded to the winner's parent or guardian only after submission and verification of the authenticated proof of guardianship by PVM India and other documents as stated before. PVM India reserves its right to waive/relax any of the above documenatation requirements as it may deem fit.
- The cost and expenses incurred towards conducting and administering the contest are being borne by PVM India out of its own funds and same are not being recouped in any way from the participants. However the prize winner for each contest shall be liable for income tax, levies and duties due and owing under applicable and statutory laws in connection with the prize(s). All other costs, expenses including travel expenses, cost of delivering etc, insurance, transfer fees, registration fees that may be applicable to avail/use/the prize(s) will be borne by the winner. In the case of the Bumper Prize, the prize claimant should possess a valid Passport. Obtaining visa and expenses related thereon shall be the sole responsibility of the prize claimant.
- Only the prize winner and not any other person or agent, may claim the prize except in the case of minor. In the case of minor, the guardian(s) thereof declared so in accordance with law and based on proof of guardianship, will be entitled to claim the prize.
- The prize(s) are non- transferable and non-negotiable. The Participants understand that the prizes are on "as is" without warranty of any kind, either express or implied, including but not limited to, merchantability, durability, suitability for any particular purpose, performances and/or non-infringement of any applicable laws.
- The use of internet may be chargeable at the regular tariff rates. Consult beforehand with your service provider to know these charges. If entries are received for participation, it is assumed that the person sending in the entry has provided us with the permission to send SMS to or call him/her, whether or not such sender is registered on the National Do Not Call Registry.
- An answer chosen as right answer i.e. correct answer to each of the video have been already decided by PVM India/its Agency which shall be binding and non-contestable.
- This contest is being organised by Maxus India, being the media agency having its office at 6th Floor, Building 9, DLF Cyber City 3, Gurgaon 122002 India. All entries sent by the Participant(s) would be received, monitored, verified, authenticated and stored by them in their computer systems.
- Entries submitted by the participants which do not comply with these terms and conditions will be rejected. PVM India reserves the right at its sole discretion to disqualify any such entry at any time.
- Mere participation in the Center Fresh Gum Charades(s) or submitting the correct answer(s) does not entitle the participant to the prize(s) unless all other terms and conditions are fully met. Failure to comply with any of the terms and conditions hereof or any fraudulent conduct shall disentitle the participant.
- By entering into the contest and accepting the prize, the prize winner(s) waive all the copyrights, rights of publicity and any related rights and specifically consents to PVM India’s right to audiography, videography, picture, tape or portray him/her as a prize winner and to exhibit this material in any and all media now existing or hereinafter created, including (without limitation) television, film, radio and print media without any compensation whatsoever for such advertising and publicity, except where prohibited by law, for a period of 5 years from the award of prize. The prize winner(s) also consents to PVM India’s unconditional right to use his/her name, voice or picture or the contents of his/her contest entry.
- By participating in the contest, each participant agrees to hold harmless PVM India and its affiliates, directors, officers, employees and agents, as well as all others associated with the development and execution of this contest, from and against any and all liability with respect to or in any way arising from this contest, the awarding and use, misuse or possession of the prize, including liability for personal injury, except where prohibited or limited by law.
- PVM India reserves the right to change the terms and conditions of this Contest and to alter or terminate the Contest at any time without prior notice. An updated version of the terms and conditions will be available on the website.
- PVM India/Agency shall not be liable for any failure to comply with its obligations mentioned herein, caused by weather conditions, fire, flood, hurricane, strike, war , riots, political unrest, civil commotion, terrorist attacks, or any other event amounting to Force Majeure and beyond their control.
- The contest is not available (void) where prohibited by any law. All relevant national and local laws apply. All disputes to be settled within the jurisdiction of the Courts in Gurgaon (Haryana) only.
- By participating in the contest, each participant specifically accepts as follows (a) that he/she has fully read and understood all the terms and conditions and be unconditionally bound by them b) that he/she satisfies the eligibility requirements under these rules c) that he/she unconditionally accepts the winner so selected d) that he/she shall honour all decisions of PVM India with regard to the contest and its interpretation and no

C) A participant can submit as many entries as it wants till he/she gets it right and even use clues to get help. If he/she can’t finally get it right, the Participant has an option to move on to the next video. If the Participant gets the answer right, he/she has one more chance to better his/her score by clicking on the “better my score” button in “My score” tab. The highest score earned out of these 2 attempts will be coded in the “Best score”.
D) Participants are requested to fill all the fields at the time of registration. The prize would be offered to the valid and registered user id selected through leader board.
E) Entries may be submitted only according to the procedure described in these terms and conditions. Entry submitted through any other mode/platform shall not be eligible for the prize/s mentioned herein.
F) In case there are two or more participants with the same score, then the Participant who has taken minimum time as per records of the agency will be considered as winner for the specific prize for which it is eligible. The decision of agency/PVM India shall be final, binding and non-contestable.
