Eligibility:

1. The Promotion “eBay Way Too Fab Contest shall be valid from 16th March, 2014 @ 00:00:01 

Hrs. till 19th March,2014 23:59:59 Hrs.

2. The offer is valid ONLY for Facebook users who are resident of India and currently residing in 

India.

3. Participation in the Promotion does not require registration or any purchase to be made 

on www.eBay.in (“Website”).

4. Participant should be of more than 18 years age in order to participate in the promotion.

Process:

1. Participants need to ‘Like’ the official Facebook page of eBay India Private Limited 

(www.twitter.com/ebaydotin) 

2. Starting 16th of March, 2014, the participants are required to do the following:

1. Participants will have log in to the microsite www.waytoofab.com through their 

Facebook Accounts.

2. Each participant will get to spin the bottle to stand a chance to win a prize.

3. Each participant will get 5 free spins everyday.

4. For additional spins, the participants would need to invite their friends to spin the 

bottle. With each invitation that is accepted, the participant gets an additional chance to 

spin the bottle.

5. One person can bag an additional spin with a particular invite only once.

6. If the participant invites a friend who has already removed the application from his 

Facebook Account, that won't qualify for an additional spin.

7. The lucky ones win a prize and the others have to go through a dare.

3. At the end of the Promotion, fifteen(15) lucky participants will be declared as winners.

4. In case of any tie between the Participants, the Participant who submits the entry first will be 

declared as winner of the Promotion.

5. If the winner is presently not the registered user or active register user of www.ebay.in , he/she 

shall register himself/herself with www.ebay.in to get his/her Prize of the Promotion.

6. The winner shall provide his/her eBay India user id to eBay India. In case winner fails to provide 

his/her registered eBay user id to eBay India within 30 days from the last date of Promotion,

he/she shall not be eligible to claim his/her Prize of the Promotion. 

7. eBay India will send the coupon code to winner at his/her registered/latest email id with eBay 

website within 45 days from the date providing his/her registered eBay user id by the winner or 

from the date of end of the promotion, whichever is later.

8. Winners are requested to update their email id to ensure that they receive their coupon code.

9. Any time before emailing the coupon code, if winner’s eBay website user id or PaisaPay access 

gets suspended from the eBay website, winner will not be eligible to receive the coupon(s) code 

under this Promotion.

10. The redemption of aforementioned coupon code shall not be applicable to the Deals of the 

week and/or any other promotional or pre-discounted products/items.

11. The Prize would be shipped to the winner at only his/her registered address with eBay website.

12. eBay will make every attempt to dispatch the prize promised, however in case of a stock out 

situation in the market, eBay will provide a similar prize of the same or higher value.

Prizes for the Winners of Spin The Bottle Contest: 

• During the promotion, total fifteen (15) lucky winners will be announced.

• These 15 winners will be eligible for eBay coupons worth Rs.500 on a minimum purchase of 

Rs.600.

• Such eBay Coupon or gift, as the case may be, shall be valid for 30 days from the date of its 

issuance and shall not be (a) transferable; (b) allowed for encashment; and (c) applicable to the 

Deals of the week and/or any other promotional or pre-discounted products/items listed on the 

eBay website.

General Terms and Conditions:

1. The data collected through this promotion will not be distributed or shared with any third party 

marketing agencies or campaigns.

2. By signing up for the Promotion, participants give us an explicit consent to contact them at 

present and in the future for any communication related to eBay, our special offers, events and 

other consumer engagements.

3. The information shared by participants with eBay will be strictly for eBay to contact participants

4. You (means the person using/participating in this promotion with the intent to receive Prize 

under this promotion or the buyer/user of eBay website) should not be in violation at any point 

in time and agree to abide by this terms and conditions and User Agreement and other Policies

5. eBay reserves the right at any time to amend/ add/ remove/ modify (in whole or part) any of the 

terms & conditions of this Promotion, or to replace, wholly or in part, this Promotion by another 

Promotion, whether similar to this Promotion or not, or to withdraw it altogether, and eBay's 

decision in this regard shall be final.

6. All decisions of eBay regarding running/ process/ results, of the promotion, data selection shall 

be final and binding on all participants of this promotion, including you. No appeals, claim and 

question shall be entertained in this regard.

7. In the event of circumstances arising outside of eBay's control, which in eBay's opinion make it 

necessary to suspend, substitute, change or cancel the Promotion, eBay reserves the right to 

suspend, change, substitute or cancel the Promotion at any time.

8. If eBay has suspicion or knowledge, that any participant has been involved in any fraudulent

or illegal activity related to this promotion, eBay reserves the right to disqualify that entrant/

participant and any related entrants/participant. Any entrant user of the promotion who, 

knowingly and with intent to injure, defrauds or deceives, files a Fraudulent Complaint 

containing false, incomplete, or misleading information may be guilty of a criminal offence and 

will be prosecuted to the fullest extent of the law. eBay reserves all the rights including but not 

limited to suspend, block, restrict, cancel the user id and remove all listings of the errant user 

and its related user id's on the Website.

9. eBay does not warrant that Twitter will run concurrently and error free during or after the 

Promotion Period and does not commit any uptime of Twitter. Further eBay shall not be liable 

for issues related to technical, human error whatsoever being entered by you or you being 

logged out of system.

10. eBay does not accept, and is not responsible for, any lost or delayed data, communication. 

eBay reminds you of the nature and limitations of the Internet and is not responsible for any 

problems, technical malfunctions of any communications network, online system, computer 

hardware/ software failure, human error, things outside the control of eBay that may affect 

entry/participation to the Promotion.

11. The products or services are listed by third parties, who are responsible and liable for complying

with commitments, communications, understanding including but not limiting to guarantees, 

warranties, services (pre, post sales) between them and you, as also complying with applicable

law of the land.

12. eBay is neither responsible nor guarantees the make, quality of the products, services, which 

is purely responsibility, liability of third party. Nor is eBay liable for any defect, deficiency, 

shortcoming or any risk associated with the quality, commitment, deliver timeline of the 

products, services.

13.eBay would undertake reasonable efforts to email/dispatch the prize within 45 days, as 

aforesaid. However, this shall be subject to no delays being caused by third party vendors or 

Force Majeure. eBay however shall not assume the risk of insurance and other related security, 

features, liability during transit.

14. For certain states within India, FORM 50/ FORM 31 are required by the courier company for 

the dispatch of the Prize. When required, the registered buyer is responsible for providing the 

courier company with the above mentioned FORM/s to receive the Prize.

15.You understand and agree that participation in the Promotion is good and sufficient 

consideration for you to agree and be bound by these Terms and Conditions.

16.Any and all taxes, including without any limitation income tax (if any) applicable on this 

Promotion and the rewards/ benefits thereto shall be borne by you and you shall deposit the 

applicable amount of taxes (if any) to eBay/ contract administrator/ applicable governmental 

authorities before user could avail any benefits, unless otherwise mandated under the 

applicable laws.

17. All communications with you will be through the application "#GetItRightWitheBay" or on your 

email or on shipping address provided by you.

18.The benefits under the Promotion CANNOT be clubbed with other offers running on the 

Website, including vouchers or any other offer available on the Website.

19. The employees and the immediate family members of the employees of eBay and its associate 

companies are NOT eligible to participate in the Promotion.

20. All decisions made by the organizers will be final.
