Terms And Conditions
1. This Contest is brought to you by Luxottica India Eyewear Pvt. Ltd. For brand Oakley (hereinafter referred to as Oakley India) with support of Brandmovers India.
2. Brandmovers India brings this contest to you with support of “Facebook”.
3. Contest is open from March 14th, 2014 to April 4th, 2014. ("Contest Period")
4. Contest is restricted to the authenticated/valid members of Facebook who are residents of India and attained age of 18 and above(Participants)
5. To participate in the contest, participants need to do the following:
a. Like Oakley India page on Facebook
b. Follow the instructions correctly
c. Answer the Contest question(s) OR send entries in the manner specified
6. The comments / views / content submitted by any individual participant under this contest or otherwise shall be treated as his / her own independent personal views and submissions
7. Oakley India does not acknowledge or agree with any such content and further shall not be held liable for any defamatory, abusive language used and loss occurring to any third party
8. At the end of the Contest Period, all Contest entries received by the Organizer during Contest Period will be considered for deciding Winners.
o Winners shall be selected from entries posted during the contest period based on the answer given, minimum number of clicks and maximum number of entries posted directly or through shares.
o Admins of Oakley India Facebook page have the final authority to decide the winner & no queries/disputes will be entertained in this regard.
o It is mandatory for the participant to be the fan of Oakley India Facebook page in order to win the prize.
o Minimum one click per user in required to be considered as a valid entry.
9. The participant warrants that the view is solely his/her original, not an infringement of any person's copyright, unpublished work and it has not been previously entered in any competition or won any award.
10. Oakley India does not exercise any control, nor does it have the means for exercising this control, amongst others, regarding the quality, originality, authenticity, legality, security or validity of the comment / share / tweets / views/ content.
11. Oakley India reserves its right, without incurring responsibility for the participant or any other person, at all times, and without prior notice, to remove any comment/view/ content that is contrary to these Conditions and/or to interrupt access / deny access of such participant to the Contest and shall be under no obligation to provide any benefits accrued under the Contest.
12. Prizes to be given to each winner under the Contest are as under:
a) A pair of Radarlock Shades
b) A Wallet
c) A carry on roller bag
d) An Oakley Backpack
e) A fuel tap
NOTE: Oakley India reserves its right to replace the prizes with those of similar nature in case of unavailability of any of the prizes
13. There will be only 2 winners of the contest. Both winners will get one gift hamper each with the following products in it: 1 pair of Oakley Radarlock shades, 1 Carry on Roller Bag, 1 Oakley Backpack, 1 Fuel Tap, 1 Wallet.
14. Participants are requested to be accustomed, satisfy and agree with these terms and conditions of the Contest each time they access the FB app before participating in this Contest
15. Oakley India shall not be responsible if the Email Id and the contact details of the Participants are incorrect or if the winner is unavailable at the address/details provided by him/ her despite reasonable attempts being made to inform him/her.
16. The winner shall respond with required contact details within 15 days of being informed of his/her winner status so that his/her prize may be dispatched. In the event that the winner does not do the above, Oakley India reserves the right to disqualify him/her immediately and choose another winner.
17. Oakley India reserves its right: (a) to disqualify any Participant /Winner if it has reasonable grounds to believe that the Participant/Winner has breached any of the terms and conditions. (b) to decide whether an alternative Winner should be selected in the event any existing Winner is disqualified from the Contest.
18. Once the winner is announced, the Organizer will subsequently contact the Winners by posting on the Oakley India Facebook page, seeking personal information viz. contact address, identity proof, pan card details, phone number, etc. Identification considered suitable for verification and subsequent redemption of prize is at the discretion of the Organizer.
19. Prizes shall be delivered at the doorstep of the Winner by post/courier as per the postal address confirmed by the Winner to Oakley India within 6 weeks from the date of announcement of the winner, subject to submission of proof of photo identity document as acceptable to Oakley India. In the event of failure to receive the prize from post/courier by the winner at his/her given postal address the Prize will be forfeited and Oakley India shall not be held responsible.
20. Winner shall be solely responsible for inspecting the conditions of the Prize at the time of receipt and inform Oakley India if the same is broken or damaged. No subsequent claims with regard to the Prize shall be entertained.
21. The participant shall not damage intellectual property rights belonging to Oakley India or third parties.
22. Contest is subject to force majeure events and situations beyond control of Oakley India and its business associates.
23. Oakley India takes no responsibility for the damages that the Participant may suffer due to errors or omissions affecting website content.
24. By participating, participant agrees that Oakley India or its affiliates may intercept and monitor any communication / view/ content that is made to the extent allowed by law.
25. Participant hereby authorizes Oakley India to communicate with him / her from time to time about the matters connected with the Contest.
26. Employees of Oakley India, Group Companies, affiliates or anyone connected with the creation/ conceptualization/ development of the contest and their families or employees are not eligible to take part.
27. Oakley India reserves its right to modify these Terms & Conditions without any prior notice.
28. The benefits/prizes under the Contest are non-refundable, non-transferable and cannot be exchanged for cash.
29. Participant shall indemnify Oakley India or its affiliate from any loss that may occur to Oakley India
30. Participation in the Contest is purely voluntary and at the sole discretion of the individual member/participant.
31. Nothing in these conditions implies any association or corporate binding between the Participant, Oakley India and Facebook, nor can this be considered any kind of joint venture.
32. Liability of Oakley India shall be limited to the extent of the benefit/prize under Contest to which a Winner participant is entitled under the conditions of Contest.
33. By participating in this Contest, Participants agree to be bound by these terms & conditions and waive any right to claim ambiguity in these terms & conditions.
34. Participants agree to release, discharge, indemnify and hold harmless Oakley India and its directors, officers, employees and agents, from and against any claims, damages or liability resulting in whole or in part, directly or indirectly due to non-adherence of the terms and conditions or due to submission of abusive, defamatory comment / views / tweets / content submitted for the contest by the Participants or use of website to participate in the contest or acceptance of any prize and/or participation in the Contest.
35. Oakley India reserves its right to use, display, publish, announce or refer to the entries or details or photograph or name ("Material") of any Participant under the Contest in electronic or print media or any other media as they may deem fit. By participating in the Contest the Participant hereby unconditionally agrees to the same, without any cost to Oakley India.
36. Decision of Oakley India in respect of Contest, selection process, benefits/prizes, usage of entries or any matters related thereto shall be final and binding and no correspondence will be entertained in this regard.
37. All disputes are subject to exclusive jurisdiction of the competent courts in Delhi only.
38. Participant unconditionally agrees that he/ she shall not:
(i) do anything which violates any of the Terms. (ii) make any Misrepresentation. (iii) do anything that does not comply with generally accepted Internet etiquette including (without limitation) the excessive use of inflammatory or antagonistic criticism ("flaming"), or wastefully and unnecessarily including previous communications in any postings.(iv) perform System Abuse. (v) propagate, distribute or transmit Destructive Code, whether or not damage is actually caused thereby (vi) Post abusive, obscene, threatening, harassing, defamatory, libelous, offensive or sexually explicit material.(vii) Intentionally make false or misleading statements. (viii) Offer to sell or buy any product or service. (ix) Post material that infringes copyright. (x) Post information that he/ she knows to be confidential or sensitive or otherwise in breach of the law.
39. All rights as to choosing the winner vest with Oakley India and shall be done as per the procedure adopted by Oakley India with or without supervision of any third party.
40. Whenever called for, Participant will be required to complete all formalities as may be communicated by Oakley India or its affiliate including but not limited to providing his/her authentic and correct information, failing which he/she shall be disqualified at any time or at any stage. In case false information is revealed at any time after participation, the Participant shall be liable to return all benefits provided under the Contest.
41. Oakley India reserves the right to restrict / bar any person from participating in the Contest without quoting any reasons for the same.
42. The Contest can be discontinued or modified at any time at the sole discretion of Oakley India without stating any reasons; no claim in this regard shall be entertained.
43. Participants found indulging in any malpractices such as cheating or creating dubious profiles etc., shall be disqualified from the contest at any time and shall not be eligible for any prize/gift.
44. Terms and conditions of Facebook shall be deemed to be a part of these Terms and Conditions.
45. These Conditions shall be governed by Indian law. Any claim, legal procedure or lawsuit arising in connection with them shall solely be subject to the jurisdiction of the Courts of Delhi.
